What power of attorney notarization covers

A power of attorney is a document in which a person, the principal, appoints another person, the agent or attorney-in-fact, to act in specified matters on the principal’s behalf.

When a power of attorney requires notarization, the notary establishes the principal’s identity using satisfactory evidence permitted by California law and performs the required notarial act. The notarization concerns the signature, not the legal effect of the authority the document grants.

What to expect at a signing

The principal appears in person with the completed document and must be identified through satisfactory evidence permitted by California law. No particular identification document is promised acceptable until it is reviewed.

The document’s instructions, the requesting party, and applicable law determine whether witnesses or other steps are required. The principal is responsible for understanding the authority being granted; the notary cannot draft a power of attorney, choose the notarial act, or advise on its legal effect.
